1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Coach by ThinkCode, LLC ("Coach," "we," "our," or "us") and our website located at coach.thinkcode.ai (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any such modifications.

Coach is an iOS app (currently in TestFlight beta) that provides AI-powered health coaching. Our Service includes:

• AI-powered health coaching and wellness insights generated by Anthropic Claude AI
• Integration with Apple HealthKit, Oura, and Whoop to sync your health data
• Health data visualization and trend tracking
• Beta program access to early features

4. Beta Program

Coach is currently in beta, distributed via Apple TestFlight. By using Coach, you understand and agree that:

• The Service is provided "as-is" without any uptime guarantees
• Features may change, break, or be removed without notice
• We may make changes to the app that require you to update or re-install
• Beta software may contain bugs that could affect your experience
• Your feedback helps us improve — please report issues to scott@thinkcode.ai

5. Health Data

By connecting Apple HealthKit, Oura, or Whoop to Coach, you grant us permission to access and process your health data to generate coaching insights. You understand that:

• Your health data is stored securely in Supabase (encrypted at rest)
• Health data is sent to Anthropic Claude AI to generate personalized coaching insights
• We do not sell your health data or share it with advertisers — ever
• You can revoke health data access at any time through your device settings or connected app settings
• You can delete all your data via Settings > Delete Account in the app

6. User Eligibility

To use our Service, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

If you are under 18, you must have parental or guardian consent to use our Service.

To access the Service, you need to create an account. You agree to:

• Provide accurate, current, and complete information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

You agree to use our Service only for lawful purposes. You may not:

• Violate any applicable laws or regulations

The Service and its original content, features, and functionality are owned by ThinkCode, LLC and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your personal health data. By using Coach, you grant us a limited license to process your health data solely for the purpose of providing the Service to you.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers and Limitations

11.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted access, particularly during the beta period.

11.2 Limitation of Liability

To the maximum extent permitted by law, ThinkCode, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless ThinkCode, LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

13. Termination

We may terminate or suspend your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

You may terminate your account at any time via Settings > Delete Account in the app, or by contacting us.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date above.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
